These Terms and Conditions ("Terms") apply to the websites, products, programs, digital content, communities, and services offered by Harmony is Fun LLC ("Harmony," "we," "us," or "our"), including through BanahWinn.com and fun.banahwinn.com. By purchasing, accessing, or using any Harmony product or service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or use our products or services.
By purchasing or using our products or services, you represent that the information you provide is accurate and that you are legally permitted to enter into these Terms.
Products and Services
Harmony offers digital products and services that may include audio recordings, Golden Ratio Frequencies, meditations, educational materials, courses, programs, community access, live or recorded content, and related resources.
The specific products, content, and access included with your purchase will be described at the time of purchase.
All purchases are optional. Purchasing one Harmony product does not require you to purchase any additional product, service, membership, or subscription.
Payments
Products purchased directly through our websites using Stripe or PayPal are one-time purchases unless expressly stated otherwise at checkout.
By completing a purchase, you authorize payment of the amount displayed at checkout. Harmony does not initiate additional or recurring charges for these purchases without your authorization.
Harmony may also offer optional memberships or subscriptions through third-party platforms such as Skool. Any recurring subscription is separately selected by you and is subject to the price, billing frequency, renewal terms, cancellation options, and other terms displayed at the time you subscribe.
Purchasing a Harmony product does not automatically enroll you in a paid subscription.
Prices are shown in U.S. dollars unless otherwise stated. Any taxes required by applicable law may be added or collected as required.
Refund Policy
Due to the digital nature of Harmony offerings and the immediate access provided to audio content, programs, and community spaces, sales are final once access has been granted, except where otherwise required by applicable law.
If you experience a technical issue accessing your purchase, contact us at [email protected] and we will make reasonable efforts to ensure you receive what you purchased.
Payment Disputes and Chargebacks
If you believe there has been a billing error, unauthorized transaction, or problem with your purchase, we encourage you to contact us first at [email protected] so we have an opportunity to investigate and resolve the issue.
If a payment is reversed, disputed, charged back, or otherwise not successfully completed, we may suspend or terminate access to the products or services associated with that payment while the matter is being resolved.
Nothing in this section limits any rights you may have under applicable law or through your financial institution or payment provider.
Personal Use and Access
Unless expressly stated otherwise, your purchase gives you a limited, personal, non-exclusive, non-transferable right to access and use the purchased materials for your own personal use.
You may not:
- Share purchased files or account access with others
- Copy, reproduce, or distribute our products or materials
- Upload our content to file-sharing, streaming, or other platforms
- Resell, sublicense, or commercially distribute our content
- Use our recordings or materials as part of another commercial product without written permission
- Make unauthorized derivative works from our proprietary materials
Purchasing a product does not transfer ownership of the underlying intellectual property.
Intellectual Property
All audio recordings, frequencies, meditations, programs, written materials, videos, graphics, branding, trademarks, course materials, and other original content provided by Harmony are owned by Harmony is Fun LLC or used with appropriate permission and are protected by applicable intellectual property laws.
No rights are granted except the limited personal-use rights expressly described in these Terms.
Community and Acceptable Use
If your purchase or participation includes access to a Harmony community or interactive space, you agree to interact respectfully and lawfully.
You may not use our communities to:
- Harass, threaten, abuse, or impersonate another person
- Share another member's private information without permission
- Engage in illegal activity
- Infringe intellectual property rights
- Distribute or promote pirated content
- Engage in excessive or unauthorized promotion or solicitation
- Commit fraud or intentionally disrupt the community
We may remove content or suspend or terminate community access when we reasonably determine that these Terms or our community standards have been violated.
User-Generated Content
You are responsible for content you voluntarily post, upload, submit, or share within Harmony communities or interactive spaces.
You represent that you have the right to share any content you submit and that doing so does not violate the rights of another person.
We are not responsible for statements, opinions, advice, or other content posted by community members.
Nothing in these Terms gives Harmony ownership of your personal content merely because you participate in a community. If we wish to use a customer's name, likeness, testimonial, photograph, video, or other identifiable content for advertising or promotional purposes beyond ordinary operation of the community, any permissions required by applicable law will be obtained separately.
Disclaimer
Harmony and Golden Ratio Frequencies are experiential audio and personal-development offerings intended for personal use.
They are not medical, psychological, psychiatric, or therapeutic services and are not intended to diagnose, treat, cure, or prevent any disease or medical or mental health condition.
Nothing provided through Harmony should be considered medical, mental health, legal, financial, or other professional advice.
If you have a medical or mental health concern, you should seek guidance from an appropriately qualified professional.
Audio Use
Golden Ratio Frequencies are standard digital audio recordings. They contain intentionally selected tones and frequencies, but they are delivered and experienced as audio in the same general manner as other music, meditation audio, or sound recordings.
They do not contain any device, substance, or physical mechanism beyond the audio itself.
Please use reasonable judgment when listening, including keeping the volume at a comfortable level and using the recordings in a manner appropriate for your circumstances.
As with any audio content, you are responsible for how, when, and where you choose to listen.
Personal Stories, Testimonials, and Results
Harmony, Banah Winn, customers, and community members may share personal stories, testimonials, experiences, beliefs, observations, or perspectives relating to Harmony products, practices, or services.
These stories and testimonials reflect individual experiences. They are not promises or guarantees that another person will experience the same or similar results.
Every person is different, and individual experiences and results may vary based on personal circumstances, participation, decisions, actions, and other factors outside Harmony's control.
Harmony provides audio, educational materials, practices, tools, guidance, and community resources. We do not guarantee any specific health, financial, relationship, emotional, spiritual, personal, professional, or other outcome.
Personal Responsibility
Our products and services are self-directed.
You are responsible for your own decisions, actions, behavior, well-being, and use of our products, services, information, and materials.
You are responsible for determining whether, when, and how to use our products and services and for exercising reasonable judgment in connection with their use.
Harmony cannot make decisions, take actions, or produce results on your behalf. By using our products or services, you accept responsibility for your own choices, actions, and outcomes.
Limitation of Liability
To the fullest extent permitted by applicable law, Harmony is Fun LLC and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of our products, services, websites, or community.
To the fullest extent permitted by applicable law, our total liability for any claim arising from a particular product or service will not exceed the amount you paid to Harmony for that product or service.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Third-Party Services
We may use third-party platforms and service providers to process payments, host content, provide community access, deliver communications, or otherwise support our services.
Those third parties operate under their own terms and policies.
We are not responsible for interruptions, outages, changes, or actions of third-party services that are outside our reasonable control. If a third-party technical issue prevents you from receiving something you purchased, we will make reasonable efforts to assist with access or delivery.
Suspension or Termination of Access
We may suspend or terminate access to our products, services, or communities when reasonably necessary because of fraud, unauthorized sharing or redistribution, intellectual property violations, serious community misconduct, abuse of our systems, reversal or nonpayment of a purchase, or another material violation of these Terms.
Termination of access does not transfer or eliminate Harmony's intellectual property rights or other provisions of these Terms that reasonably continue after termination.
Events Outside Our Control
Harmony will not be responsible for delays or failures caused by circumstances outside our reasonable control, including internet or telecommunications outages, failures of third-party platforms or service providers, natural disasters, governmental actions, cyberattacks, or similar events.
We will make reasonable efforts to restore or provide access when circumstances allow.
Privacy
Your use of our websites, products, and services is also subject to our Privacy Policy.
Our Privacy Policy explains how we collect, use, and disclose personal information and should be read together with these Terms.
Changes to These Terms
We may update these Terms from time to time.
Updated Terms will be posted on our website with a revised effective date. Changes will apply prospectively except where otherwise permitted or required by law.
Entire Agreement and Severability
These Terms, together with our Privacy Policy and any specific terms presented at the time of purchase, constitute the agreement between you and Harmony regarding the applicable products and services.
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.
Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
Governing Law and Disputes
The governing law, jurisdiction, and procedures applicable to disputes involving these Terms will be determined in accordance with applicable law and any additional dispute-resolution terms adopted by Harmony.
Electronic Acceptance
By completing a purchase, you confirm that you have had the opportunity to review these Terms and agree to be bound by them.
Electronic acceptance of these Terms, including by completing a purchase through a checkout where these Terms are made available, is intended to have the same effect as acceptance of a written agreement.
